Welcome to Diagnex. By using our website or availing our services, you agree to these Terms and Conditions. Please read them carefully before proceeding. If you disagree with any part, you may choose not to use our services or website.
1. Authorization and Consent
By availing any service from Diagnex, the client (patient or legal guardian) authorizes Diagnex to provide medical, nursing, diagnostic, vaccination, or home dialysis services as recommended by the primary physician.
The client further authorizes Diagnex to administer prescribed medications or procedures as directed by the physician. The client acknowledges that potential risks and side effects have been explained by Diagnex medical professionals or the referring doctor.
Diagnex shall not be held responsible for any adverse reactions or complications that arise despite following standard medical protocols.
2. Medical Information Disclosure
The client consents to Diagnex obtaining and sharing relevant medical records such as reports, prescriptions, and diagnostic results with healthcare providers involved in the treatment process. All records are handled with the highest confidentiality and shared only when necessary to ensure accurate and effective care.
3. Emergency Care
In case of an emergency during ongoing treatment, Diagnex professionals are authorized to provide immediate medical assistance or recommend hospital transfer. The client agrees to bear all expenses related to such interventions. Diagnex will not be liable for complications resulting from circumstances beyond reasonable control.
4. Telehealth & Virtual Consultations
Diagnex may offer virtual consultations through phone or video calls. While we strive to ensure uninterrupted sessions, technical issues like poor connectivity may occur. By using our telehealth services, you consent to the electronic storage of consultation records in accordance with data protection standards.
5. Legal Guardian Consent
If services are provided to a minor, dependent, or elderly family member, the individual providing consent confirms that they are the legal guardian or authorized representative.
6. Insurance and Payments
Diagnex services may or may not be covered under your insurance policy. It is the clientβs responsibility to confirm coverage and bear costs not included in the policy.
All payments for services, consumables, and additional expenses must be made in advance or as agreed upon. Applicable taxes will be added to all invoices.
7. Amendments and Withdrawal of Consent
These terms remain in effect until withdrawn in writing by the client. Diagnex reserves the right to modify or update terms at any time. Continued use of services implies acceptance of the latest version.
8. Cancellation and Refund Policy
- Services may be canceled by either party with prior notice, depending on the nature of the service.
- Refunds, if applicable, will be processed within 7-10 business days after necessary verification.
- For prepaid packages, partial refunds may be provided for unutilized services, subject to approval.
- Emergency or immediate care services are non-refundable once initiated.
9. Use of Medical Equipment
Diagnex may provide medical equipment (such as dialysis kits, oxygen concentrators, or monitoring devices) for patient use at home.
Terms for Equipment Use:
- Equipment remains the property of Diagnex unless sold outright.
- Clients must ensure proper handling and usage as instructed by Diagnex staff.
- In case of damage, loss, or malfunction due to misuse, the client will bear repair or replacement costs.
- For rented equipment, the refundable deposit will be processed after inspection upon return.
10. Delivery and Setup
Equipment and medical supplies will be delivered to the clientβs registered address.
Diagnex staff or biomedical engineers will handle setup and provide usage instructions.
If relocation or early return is needed, the client must notify Diagnex in advance.
Additional costs may apply for delivery to multi-story buildings without elevators, or for locations with restricted vehicle access.
11. Relocation or Return
If you move to a new address within the same city, Diagnex can assist with relocation of the equipment at a nominal charge.
In case of cross-city relocation, similar equipment may be arranged based on availability.
All equipment must be returned in clean and working condition. Deposits will be refunded post quality inspection within 7 working days.
12. Refundable Deposits
A refundable security deposit may be collected for certain rentals. The deposit will be returned to the same account or person from which it was received, after deduction (if any) for damages or pending dues.
13. Service Limitations
Diagnex provides non-emergency medical and home care services.
We do not offer ambulance support, intensive critical care, or emergency ICU-level medical services.
In case of life-threatening conditions, clients are advised to contact emergency services or visit the nearest hospital immediately.
14. Liability Disclaimer
Diagnex and its staff follow all necessary medical protocols and ethical standards. However, we are not liable for:
- Outcomes resulting from inaccurate medical history provided by the client
- Delays or interruptions beyond our control
- Complications inherent to medical procedures
The client agrees to indemnify Diagnex against any claims arising from improper use of services or equipment.
15. Jurisdiction
All terms and disputes are governed by the laws of the Republic of India. Any disputes shall be subject to the jurisdiction of the courts in Kolkata, West Bengal.
